“Services” refers to the Instapoll website and any related services provided by us.
“User Content” refers to the polls, questions, choices, images, and any other content created or uploaded by users.
2. Eligibility
Our Services are available to all individuals. However, you must sign up for an account to create and manage polls.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to use the Services to create or distribute content that is offensive, defamatory, or violates any laws. We reserve the right to remove such content and terminate accounts that violate this policy.
5. User Content
You retain ownership of the content you create. By using our Services, you grant Instapoll a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content for the purpose of operating and promoting the Services.
Please note that polls are public and can be shared by anyone, including Instapoll, for marketing or other purposes.
6. Payment and Refunds
Users can create one free poll. Additional polls and add-on features require payment. If you are dissatisfied with a paid feature, you may request a refund by contacting us at support@instapoll.run.
7. Service Availability
We strive to keep our Services up and running; however, we do not guarantee uninterrupted availability. Use of the Services is at your own risk, and we are not liable for any data loss or damages resulting from downtime.
8. Termination
We reserve the right to terminate or suspend your account at our discretion. Offensive content will be purged, but other data may be retained as per our Privacy Policy.
9. Modifications to Terms
We may modify these Terms at any time. Changes will be effective upon posting, and the “Last Updated” date will be revised accordingly. Continued use of the Services after changes constitutes acceptance of the new Terms.
10. Dispute Resolution
Any disputes arising from these Terms or the use of our Services will be governed by the laws of the United States. You agree to resolve any claims through binding arbitration, and you waive the right to participate in class-action lawsuits.

14. Limitation of Liability
To the maximum extent permitted by law, Instapoll shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Services;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the Services;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party;
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services.
In no event shall Instapoll’s aggregate liability for all claims related to the Services exceed the greater of twenty U.S. dollars (U.S. $20.00) or the amount you paid Instapoll, if any, in the past twelve months for the Services giving rise to the claim.
